دلارا دارابی اعدام شد. به همین سادگی! دلارا که بر اساس گزارشهای اعلام شده بوسیله دستگاه قضائی جمهوری اسلامی بنا بر اعتراف خود در 17 سالگی یک انسان را بقتل رسانده بود بعد از چند سال تاخیر در زندان جمهوری اسلامی به دار آویخته شد تا عدالت اسلامی اجرا شده باشد. چند روز پیش در خبری در سایت یاهو چنین آمده بود که یک بچه 17 ساله بعد از اینکه بدون توجه به حرف مادرش همراه با دوستان خود برای تفریح رفته بود ناپدید شد. یادم آمد به دلارا دارابی که چند سال پیش احتمالا بدون توجه به حرف مادر همراه با دوستی به گردش رفته بود و در یک درگیری که برای آنها پیش آمد، جوان دیگری که با آنها درگیر شده بود کشته شد.

همه داستان، اگر واقعیت هم داشته باشد، حکایت از کمی سن افراد درگیر و ناگهانی بودن اتفاق و ناخواسته بودن آن میکند که در نهایت به نتیجه ای نامطلوب و از دست رفتن جان یک انسان انجامید. بدون شک هیچ چیزی نمیتواند قتل یک انسان را بسادگی توجیه کند و بهمین جهت چنین عملی شایسته مجازات است اما چگونگی اجرای مجازات خود یک جنبه انسانی دارد که پس از ثبوت جرم در طی یک دادگاه عادلانه برای کمک به جامعه و در مسیر بهتر شدن آن باید انجام گیرد. در طی 30 سال گذشته مفهوم مجازات در کشور ما به انتقام تغییر کرده و دولت جمهوری اسلامی با استناد به احکامی که بر اساس تعابیر ملاهای ریز و درشت خود از اسلام و در دادگاههای شرعی که همه یادآور دیوان بلخ هستند، مردم را رو در روی یکدیگر قرار داده و نقش خود را در این ماجرا به یک باجگیر و داور بی تدبیر کاهش داده است.

رواج مجازاتهای غیر انسانی و نامتناسب با جرائم آنچنان متداول و مرسوم شده که یاد آور روزگار بعد از شکست ایرانیان در حمله اعراب و مغولها میتواند باشد. ایرانیانی که دارای توانائیهای مالی نیستند در واقع تنها قربانیان این سیستم قضائی و عدالت اسلامی میباشند و این شامل اکثریت بزرگی از مردم ایران است. شاید از یادها نرفته باشد که همین چند سال پیش فرزند یک آخوندی که زمانی در وزارت اطلاعات جمهوری اسلامی دارای منصب مهمی بود در تهران دو نفر از افراد پلیس را بضرب گلوله بقتل رساند و بعد هم گفته شد که اشتباهی این کار را کرده بود و سر و ته قضیه با دیه به هم آورده شد! نمونه های این وقایع در 30 سال گذشته کم نبوده. همین دو سه سال پیش بود که دست اندر کاران عدالت اسلامی "برای دیگران" زهرا کاظمی را با زدن ضربه به سرش بقتل رساندند و با کمال پرروئی از دادن جنازه او به خانواده اش خود داری کردند و جنازه را بدون اطلاع و اجازه خانواده دفن کردند و بعد هم با هر گونه اقدام برای نبش قبر و بازبینی جنازه مخالفت کردند!

نمونه دیگر قتل زهرا بنی یعقوب در همدان بود که بوسیله اجامر و اوباشی که در خدمت جمهوری اسلامی هستند به بهانه های واهی دستگیر و در باز داشت مورد تجاوز قرار گرفته و بقتل رسید. بعد هم اعلام کردند که خود کشی کرده در حالیکه هرگز چنین امکانی برای او وجود نداشت! این موضوع که پدر زهرا بنی یعقوب خود در تشکیلات سپاه پاسداران جمهوری اسلامی کار میکرده نشان میدهد که در این هرج و مرجی که نام جمهوری اسلامی به خود گرفته هر کسی میتواند به راحتی قربانی دیگری برای دستگاه سرکوب و باصطلاح عدالت جمهوری اسلامی باشد! چگونه از چنین دستگاهی میشود انتظار داشت که انسانی باشد؟

دلارا دارابی اعدام شد و صدها جوان دیگر نیز که در کودکی مرتکب جرمی همانند او شده اند هم اکنون در انتظار همان سرنوشت در زندانهای جمهوری اسلامی هستند. در کدام دوره از تاریخ کشورمان چنین بوده؟ چرا چنین شده؟

حدود بیست سال پیش به مناسبتی به یکی از مراکز روان درمانی در کشورمان رفته بودم. پیرزنی روستائی دستهایم را گرفته بود و از من میخواست که دستور بدهم تا بچه هایش را به او بر گردانند! آنجا پر بود از امثال او. او را آرام کردم و از نرس پرسیدم بچه های این زن چه شدند؟ و نرس به آرامی گفت در جنگ کشته شدند ولی او نمیداند و حالا او را اینجا آورده اند. به کسی آزاری ندارد و فقط گریه میکند، مانند خیلیهای دیگر! بعد مرا به اطاقی برد که پرونده ها نگهداری میشد. قفسه ها همه پر بود و تعداد زیادی از پرونده ها روی زمین انبار شده بود. پرسیدم مگر نمیتوانید قفسه دیگری بخرید؟ جواب داد متاسفانه سرعت رشد پرونده ها از روند اداری خیلی بیشتر است! او گفت که ما پیش از انقلاب فقط دو تا قفسه داشتیم که یکیشان کاملا خالی بود ولی حالا، این سومین اطاقیست که ما برای نگاهداری پرونده ها استفده میکنیم چون آن دوتای دیگر اصلا جا ندارد! بعد هم دو اطاق دیگر را نشانم داد که در هر کدام چند قفسه بود که همه پر بودند و روی زمین هم پر بود از پرونده ها! با خودم گفتم خدا میداند که چقدر از مردم ما هستند که حتی به چنین جاهائی مراجعه نمیکنند در حالیکه هزار مشکل روانی دارند و از طرفی دولت جمهوری اسلامی همه هم و غمش برای دار و دسته خودش است و بدنبال بوجود آوردن هیچگونه امکانات برای مردم نیست چه برسد به اینکه به فکر سلامت روان آنها باشد!

چطور میشود در چنین اوضاعی دم از عدالت زد؟ ایرن امروز تبدیل به میدانی شده که رهبران جمهوری اسلامی مانند رهبران رم قدیم در سکوی تماشاگران آن نشسته اند و مردم را مانند گلادیاتورها در میانه میدان به جان هم انداخته اند. عدالت جمهوری اسلامی عدالت گلادیاتورهاست و آنها که در سکوی تماشا گران نشسته اند مشمول آن نمیشوند! در این عدالت دیوان بلخی که همه چیز وارونه است دلارا ها، زهرا کاظمی ها و زهرا یعقوبیها و دیگران اگر نتوانند بیگناهی خود را به روشی که حاکمان شرع جمهوری اسلامی میپسندند اثبات کنند، باید تاوان بدهند.

In Today Iranian paintings only two colors make sense, one Black representing Oil, Carter, British, Taazi Appeasers and Red representing for Blood Oil and Islamists …

Mother and sisters of Delara Darabi at Golestan Gallery in Tehran. They are very worry for the possible execution of their sister/daughter.
Delara Darabi, 20, was sentenced to death three years ago. Now she tries to defend herself by painting. In her exhibition at Golestan Gallery Oct. 20-2006 she wrote: "these paintings are my swear to what I have not done. So maybe colors would return me back into the life."
Some of her paintings are done using only her fingers, nails, and a black color in the dark days of her loneliness in prison. In her first trial, she claimed that she killed her cousin so she could save her boyfriend’s life.

Amnesty International has expressed outrage at the execution in Iran this morning of Delara Darabi, a child offender executed despite an international ban on capital punishment of those convicted of crimes committed when under the age of 18.

Delara Darabi was hanged in Rasht Central Prison earlier today, becoming the second person to be executed in Iran this year after being convicted of a crime she was alleged to have committed while still under 18. Ms Darabi was executed despite her having been given a two-month stay of execution by the Head of the Judiciary on 19 April.

Amnesty International Middle East and North Africa Programme Deputy Director Hassiba Hadj Sahraoui said:

'Amnesty International is outraged at the execution of Delara Darabi, and particularly at the news that her lawyer was not informed about the execution, despite the legal requirement that he should receive 48 hours' notice.

'This appears to have been a cynical move on the part of the authorities to avoid domestic and international protests which might have saved Delara Darabi's life.

"This indicates that even decisions by the Head of the Judiciary carry no weight and are disregarded in the provinces.'

Delara Darabi was convicted of murdering a relative in 2003 when she was 17. She initially confessed to the murder, apparently believing she could save her boyfriend from the gallows, but later retracted her confession. She was being detained at Rasht Prison in northern Iran since her arrest in 2003, during which time she developed a significant talent as a painter.

Amnesty does not consider her trial to have been fair. The courts refused to consider new evidence that her lawyer said would have proved she could not have committed the murder. The human rights organisation had campaigned for her life since her case came to light in 2006, urging the Iranian authorities to commute her death sentence and calling for a re-trial in proceedings that met international standards.

The execution of Delara Darabi brings to at least 140 the number of executions in Iran so far this year. She is the second woman known to have been executed this year and the second child offender. Since 1990 Iran has executed at least 42 child offenders, eight of them in 2008 and one on 21 January 2009. These executions went ahead in total disregard of international law, which unequivocally bans the execution of those convicted of crimes committed when under the age of 18.

Iranian authorities executed Delara Darabi on Friday morning in Rasht Central Prison in northern Iran since her arrest in 2003.

She was the second juvenile offender to be executed this year, Amnesty International said.

"[H]er lawyer was not informed about the execution, despite the legal requirement that he should receive 48 hours' notice," said Hassiba Hadj Sahraoui, deputy director of the Middle East and North Africa Program.

"This appears to have been a cynical move on the part of the authorities to avoid domestic and international protests which might have saved Delara Darabi's life."

Delara Darabi was convicted after confessing the murder of a relative in 2003 when she was 17, but later retracted her statement, Amnesty International said.

Darabi was executed even after she was given a two-month stay of execution by the Head of the Judiciary on April 19 in Iran.

"It appears that Iran's head of Judiciary has no ability to control even his own judges," Zama Coursen-Neff, deputy director of the children's rights division at Human Rights Watch, said in a separate statement.

"This is an outrageous violation of Iranian as well as international human rights law, and a callous affront to basic human dignity."

The UN Convention on the Rights of the Child - an international treaty to which Iran is a party - clearly bans the execution of offenders who committed a crime when under the age of 18, the human rights group said.

Since January 2005, only four other countries are known to have executed juvenile offenders: Saudi Arabia, Sudan, Pakistan, and Yemen.
