Iranian Dissident Dies After Hunger Strike

A jailed former student leader died in prison after a nine-day hunger strike, a human rights activist said Monday. Akbar Mohammadi, who died late Sunday, was arrested after taking part in anti-government protests at Tehran University in July 1999 _ the country's biggest domestic crisis since the 1979 Islamic revolution.

He was sentenced to death but the sentence was later reduced to 15 years in prison.

He was released on medical leave last year to seek treatment for a spinal-cord injury suffered after his arrest, said Kohyar Goodarzi, a member of the Student Committee of Human Rights Reporters of Iran.

Two months ago, toward the end of the yearlong leave, Mohammadi "was arrested without any explanation," Goodarzi said, and placed in Tehran's notorious Evin prison.

Mohammadi went on a hunger strike to protest a lack of proper medical care, Goodarzi said.

"He suffered a heart attack as a result of his strike," Goodarzi said.

Senior prison official Sohrab Soleimani said Mohammadi had been receiving appropriate medical care.

"He was drinking water and tea and was under doctors' supervision," the semiofficial Islamic Students News Agency quoted Soleimani as saying.

Some 25 Iranian political activists and prisoners issued a statement criticizing the government for its treatment of Mohammadi.

نیوشا بقراطی (رادیو فردا): اکبر محمدی فعال دانشجویی پس از 9 روز اعتصاب غذا بطور مشکوک در زندان جان سپرد. برخی خبرگزاری ها اعلام کردند که او دچار ایست قلبی شده است. اکبر محمدی در دو روز پایان زندگی اش دست به اعتصاب غذای خشک زده بود. پیکر او برای کالبد شکافی به بیمارستان سعادت آباد تهران منتقل شد. خانواده وی هم اکنون در ترکیه بسر می برند. رضا محمدی برادر اکبر که مقیم آنکارا است در مصاحبه با رادیو فردا می گوید:
رضا محمدی: ساعت هفت و نیم صبح از زندان خبر دادند که اکبر شهید شد. ما باور نمی کردیم.

ن.ب: نگفتند که نحوه درگذشت آقای اکبر محمدی چطور بوده؟

رضا محمدی: دارو ریختند در دهن اکبر بعد از ریختن دارو آوردند در بند زندان. اکبر بعد از نیم ساعت چشمهایش را بست با همان لباس خونین... (گریه شدید)

ن.ب: شما با وکلای برادرتان هم تماس داشتید؟

رضا محمدی: ما با وکیلش تماس داشتیم . خبر دادند که وکیلش را هم دستگیر کردند چون می خواست نامه بدهد سازمان ملل متحد. آقای بهرامیان را دستگیر کردند.

ن. ب: رضا محمدی گفت پدر و مادرش امشب ساعت ده و نیم از ترکیه عازم فرودگاه امام خمینی تهران می شوند تا فردا صبح قرار است با حضور در زندان اوین پیکر اکبر محمدی را تحویل گیرند. از آنجا که خانواده محمدی از لحاظ روحی در وضعیت بحرانی بسر می برند در تماس با مراد معلم یکی از دوستان خانوادگی و نزدیک آنها که در جریان امر قرار داشت جزییات بیشتری را جویا شدم.

مراد معلم: بعد از 5 روز اعتصاب غذا دوستانشان ایشان را می برند به بهداری شاید بتوانند سرم وصل کنند. در بهداری ایشان مقاومت می کنند نمیگذارد سرم وصل شود. بعد فهمیدیم علت این بود که یک سری نمایندگان می خواستند بازدید کنند او را بردند بهداری که نبینند. دهنش را با چسب بسته بودند که صدای شعار می داد که کسی نشنود.

ن.ب: آقای معلم، آقای رضا محمدی گفتند که مسئولان زندان دارویی در دهان اکبر ریختند.

مراد معلم: دست و پایش را بسته بودند با زنجیر روی تخت. آقای مرتضوی و آقای عباسی رئیس زندان می آیند سروقتش و دارویی بدهنش می ریزند که او را برمی گردانند داخل بند می گویند حالا که اعتصابت را نمی شکنی همینجا بیفت مثل سگ بمیر. چند دقیقه بعد خبر دادند که درگذشته.

ن.ب: آقای اکبر محمدی هم خودش دارو مصرف می کرد از کجا می دانیم که داروی خودشان نبود. این خبر را شما از کجا شنیدید؟

مراد معلم: این خبر را از دوستانشان که درون زندان بودند از سه کانال مختلف زنگ زده بودند که به پدرمادر محمدی اطلاع بدهند. سه کانال مختلف این مطالب را تایید کردند که در دهنش آقای مرتضوی حاضر شد آقای عباسی حاضر شد جلوی یک نفر دیگر توی دهنش دارو ریختند نه داروی خودش. ایشان بعد از چند دقیقه که درون بند انداختند...

ن.ب: کی ها بودند این دوستانشان که می گویید آنجا حضور داشتند.

مراد معلم: آقای طبرزدی بود، حجت بختیاری بود، خالد هردانی بود. بغل دستتش بودند. چند لحظه بعد از اینکه برده بودند فوت می کند.

ن.ب: آقای رضا محمدی گفتند که خلیل بهرامیان وکیل برادرشان دستگیر شده. شما اطلاعی دارید؟

مراد معلم: من یک ساعت و نیم پیش زنگ زدم به خلیل بهرامیان وکیل زندانیان سیاسی. به من گفتند من دارم می روم زندان اگر مرگ اکبر محمدی صحت داشته باشد من به سازمان ملل متحد شکایت می کنم. تا دو ساعت و نیم دیگر زنگ بزنید من کل جریان را با شما در میان می گذارم. یک ساعت بعد که ایشان به زندان رسیده بودند بچه ها زنگ زدند گفتند آقای بهرامیان را گرفتند و ایشان در زندان است.

ن.ب: تلاش رادیو فردا برای تایید این خبر بی نتیجه مانده است. وکیل دیگر اکبر محمدی از چنین خبری اظهار بی اطلاعی کرده و سعی ما برای تماس با آقای بهرامیان نتیجه ای در بر نداشت.

عبداکریم لاهیجی نایب رئیس جوامع جهانی دفاع از حقوق بشر در این زمینه می گوید:

عبدالکریم لاهیجی: اکبر محمدی هفت سال ازعمرش را بخاطر شرکت در یک تظاهرات در زندان گذراند. پس از دستگیری او در یک دادگاه انقلابی بدون رعایت هیچیک از قواعد دادرسی او را محکوم به حبس کردند. بدرفتاری ها و شکنجه هایی که بر او وارد کردند سلامت او به تمام معنا از دست رفته بود. او مبتلا به بیماری های گوناگون بود. جمهوری اسلامی، مقامات قضایی و مسئولان زندانهای جمهوری اسلامی در این مرگ مسئولیت دارند. ما خواستار یک تحقیق همه جانبه از سوی سازمانهای بین المللی هستیم. برای اینکه علت مرگ مشخص شود.

ن.ب: صادق نقاشکار سخنگوی برونمرزی برخی از زندانیان سیاسی می گوید

صادق نقاشکار: مرگ اکبر محمدی به مثابه زنگ خطری است در خصوص دیگر زندانیان سیاسی. آقای نقاشکار می گوید: این هشداری است به همه جهان که جمهوری اسلامی اینگونه با زندانیان بخاطر اعتقاداتشان رفتار می کند، بخاطر دفاع از آزادی. زندانیانی که در سراسر ایران هستند.

ن.ب: در بیانیه ای که از سوی گزارشگران حقوق بشر صادر شده نام 25 تن بعنوان برخی زندانیان سیاسی مطرح ذکر شده است. لیستی که تا روز یکشنبه دربرگیرنده نام اکبر محمدی نیز بود.

Seven long and terrible years of torture, abuse and maltreatment, tragically ended yesterday for our courageous compatriot, Akbar Mohammadi, with his murder at the hands of his jailers, who carried out the execution order issued by the security apparatus of the criminal clerical regime.

Akbar Mohammadi was a prominent student dissident and among the most courageous and important symbols of constitutional monarchists, who, in spite of the deafening silence of many among our opposition and diaspora, bravely endured untold sacrifices, spearheading our struggle against the evil autocracy called the Islamic Republic.
Akbar’s name will forever be inscribed in the annals of our history, highlighting our people’s struggle in general, and that of the students’ movement in particular. His courage, dedication and ultimate sacrifice will serve as a beacon lighting our way in our fight for liberty!

I share the grief of this tragic loss with his family and offer my heartfelt condolences to my compatriots, in particular to all his peers and friends in Iran and around the world.
May his soul rest in peace, while we continue where he left us!

A few hours ago, SOS Iran learned that Mr. Ahmad Batebi, a freedom fighter and one of the leaders of the Student Movement, has been arrested in his house in Iran. Around 5 PM local time on Saturday, July 29, 2006, five plain-clothed guards from Iranian Information Agency arrested Mr. Batebi in his home. The guards searched Mr. Batebi's home for over 3.5 hours and removed and confiscated many of his personal belongings.
We hold the government of the Islamic Republic in Iran (IRI) responsible for Mr. Batebi's well-being and demand his unconditional and immediate release.

It is important that we inform IRI that it is responsible for protecting every Iranian citizen, including all political prisoners and Mr. Batebi. If harm comes to any of our countrymen and women, the international community shall hold the government of the Islamic Republic of Iran and its leaders legally responsible.

This afternoon Ahmad Batebi, was arrested in front of his home in Tehran by plain clothes secret service agents of the Ministry of Intelligence and Security of the Islamic Republic of Iran.

At 5 pm on Saturday evening, as Batebi and his wife Somaya, exited their apartment building they were accosted by several agents, forcing Batebi and Somaya back inside for interrogation and inspection of their home.

Somaya Batebi said that the agents spent 3 hours inspecting their apartment and finally gathered and confiscated Batebi?s personal property, including his computer, cellular phone, CD?s, several files and family photo albums.

In a phone call, Ahmad Batebi?s father expressed fear and concern for his son?s safety and wellbeing; Batebi?s father said that if his son?s situation is not clarified by tomorrow, Sunday, July 30th, he and other members of the Batebi will start a hunger strike.

Batebi?s father also stated that Ahmad himself had communicated that should he be illegally re-arrested, he would go on hunger strike during the initial hours of his detention.

It appears that after interrogation that Ahmad Batebi would have been transferred to detention center 209 of the Ministry of Intelligence and Security.

Secret meeting of the axis of terror in Damascus

Kuwait?s Al Seyassah newspaper reported that Hassan Nasrollah, the capo of Lebanon's Hezbollah traveled to Damascus to meet with Syrian leader Bashar al-Asad and the secretary of the supreme national security council of the Islamic Republic of Iran, Ali Larijani. On Thursday, the Islamic regime?s news media announced Larijani?s trip to Syria. However, later they denied it.

Al Seyassah however wrote that Nasrollah was able to reach Syria with the assistance of Syrian security agents stationed in Lebanon. The topic of discussion between the 3 men will be about the ways Syria and the Islamic Republic of Iran can deliver weapons and ammunition to Hezbollah; Nasrollah intends to be consulting with his ?big brothers?.

This newspaper reported that the Hezbollah capo appeared in plain clothes in Damascus without his usual clerical attire and rode in a bullet proof, Syrian Baathist security vehicle. Since the beginning of the war against Lebanese Hizbullah, this is the first time it is reported that Nasrolah has in fact traveled out of Lebanon. The paper also reported that while Larijani has traveled to Damascus in order to deliver to Nasrollah his new set of orders from Tehran, the Islamic Republic of Iran?s radio and television had claimed that the true nature of his trip was "to achieve the humanitarian objectives".

Simultaneously, the Turkish press reported that Turkish border patrols and customs agents have begun conducting detailed searches of cargo trucks, passenger cars and airplanes originating from Iran that pass through Turkey on the way to Damascus; this is in order to prevent the delivery of any arms and ammunition from the Islamic Republic of Iran to Lebanon.

Manouchehr Mohammadi has been attacked and tortured in prison for his continuous support and encouragement of the youth to set up gatherings and non-violent resistance and therefore, with his brother have been transferred many times to solitary confinement. Two weeks prior to both the first and the second anniversary of Tehran University’s dormitory incident he went on hunger strike, and was transferred to solitary confinement.

On the third anniversary of the student uprising Manouchehr and Akbar were both transferred to Qaemshahr (Shahi) and Sari prisons; first to solitary confinement and later on to the section for murderers. His hunger strike angered the prison officials when they decided to tie him on a cross. While on a cross he was lashed and beaten until four of his ribs were broken. Then he was transferred to his cell where in order to use its toilet he could only lie on the floor and had to drag himself for an hour in order to reach it.

On the fourth anniversary Manouchehr was transferred with his eyes closed to the Sepah prison. After five weeks in solitary confinement and under tortures he was then brought to the revolutionary court. The new sentences passed were (i) One year imprisonment for his political activities, (ii) 30 lashes and IR300,000 fine followed by a year imprisonment for his complains to the judiciary officials.

In the meantime Akbar was transferred to Evin prison. Simin, their sister and their father Mr. Mohammad Mohammadi took the case up with the Ministry of Information. Soon they were both arrested, Mr. Mohammad Mohammadi was imprisoned where after his heart failure was transferred to a hospital and Simin Mohammadi was not allowed to attend her university exams. Later on they were both released on bail.

At the time of his arrest Akbar Mohammadi was a Tehran University’s student in the faculty of Social Sciences who was accused for helping the students in the dormitories by taking food and water to them on 9th July 1999 uprising.

Iran's treatment of political dissidents came under renewed scrutiny yesterday after a former student leader died in prison after going on hunger strike.
Akbar Mohammadi, jailed for his role in anti-government protests, died on Sunday in Tehran's notorious Evin prison, apparently after a heart attack. He had gone on hunger strike nine days earlier in protest at the lack of medical treatment for a spinal injury suffered while in captivity, supporters said.

His lawyer, Khalil Bahramian, said the authorities had breached international conventions and Iranian law by denying him access to his client during his fast.

The death drew condemnation from Amnesty International UK, which accused western governments of ignoring Iran's "appalling" human rights record and focusing instead on its nuclear programme. Iranian officials deny holding political prisoners but critics say at least 50 inmates are being detained for dissent.

Mr Mohammadi was condemned to death for his role in student protests at Tehran University in 1999, but the sentence was commuted to 15 years in prison after the intervention of Iran's supreme leader, Ayatollah Ali Khamenei. Last year he was released on 12 months' medical leave but was reimprisoned two months ago without warning, his lawyer said.

His death follows an outcry about the arrest in May of an Iranian philosopher, Ramin Jahanbegloo, who is in Evin prison awaiting trial on unspecified charges.

Iran's highest profile dissident, Akbar Ganji, recently embarked on a tour of Europe and the US to bring attention to the plight of Iranian political prisoners. Mr Ganji, a journalist, was released in March after six years in jail.

رضا محمدی: صبح خبردار شدیم که ساعت 4 صبح اینها را حرکت دادند به شهرستان آمل همراه با جنازه اکبر. پدرومادرم گفتند شما اقلا اجازه بدهید که منوچهر از زندان مرخص شود تا برادرش را ببیند. برادری که هفت سال با هم در یک سلول بودند. منوچهر گفته بود نگذارید اکبر را دفن کنند تا من بیایم. جنازه اکبر را بردند شصت کیلومتری آمل و حدود 5 هزار نیروی امنیتی ریختند در منطقه. وی می گوید پدر و مادرش خواهان کالبد شکافی اکبر بودند ولی او را دفن کردند.

خلیل بهرامیان وکیل اکبر محمدی: این کار کاملا خلاف قوانین داخلی و بین المللی است. طبق اطلاعاتی که به من دادند از داخل زندان، هنگام دیدار نمایندگان مجلس از زندان، او را به تخت بهداری زندان بستند و دهانش را هم چسب زدند که این خود می تواند یکی از عوامل مرگ باشد. طبق ضوابط جهانی اگر یک مرگ مشکوکی صورت بگیرد، خود دادستان یا خانواده فوت شده می توانند درخواست کالبدشکافی کنند و حضور وکیل نیز الزامی است در این موارد. از پدر و مادر اکبر محمدی خواستم که وکالتنامه ای را امضا کنند تا من بتوانم از طرف آنها صحبت داشته باشم و سپس من مستقیما از سوی خود رئیس قوه قضاییه جمهوری اسلامی درخواست خواهم کرد دستور اکید و ویژه دهند نقش قبر شود، با حضور یک هیات پزشکی غیروابسته این جسد مورد معاینه قرار گیرد. آقایان ادعا دارند اکبر محمدی به طور طبیعی فوت کرده. اگر چنین چیزی هست، چه وحشتی است که فوری این را ببرند دفن کنند و درخواست خانواده متوفی را نادید بگیرند. تمام اینها علامت سئوال است و در تاریخ باقی خواهد ماند. نباید آقایان بگذارند این پرونده بحرانی مانند بحران پرونده زهرا کاظمی ایجاد کند.

ن . ب: اما در پی اعلام این که پدر و مادر اکبر محمدی در مقابل زندان اوین حضور خواهند یافت، صبح امروز سه شنبه گروهی از مردم به نشانه حمایت از خانواده محمدی در مقابل زندان اوین دست به تجمع زدند. فریبرز سروش خبرنگار در تهران می گوید:

فریبرز سروش: نیروهای امنیتی با حضور در خیابان مجاور زندان، مانع از برگزاری هرگونه تجمع و گردهمایی شدند و مردم را بارها متفرق کردند. فرصتی برای سازماندهی نبود و پلیس مانع از تجمع خودروها و مردم در برابر زندان اوین می شد.

ن . ب: آخرین دوستان و نزدیکان اکبر محمدی نیز شامگاه گذشته در ساعت هشت شب مراسم یادبودی را برای وی برگزار کردند. این مراسم در بند 350 زندان اوین با یک دقیقه سکوت آغاز شد و به گزارش کمیته دانشجویی گزارشگران حقوق بشر، با سخنرانی ناصر زرافشان، خالد هردانی و حشمت الله طبرزی ادامه یافت.[/size]

The death in custody of Akbar Mohammadi, a 38-year-old former student, in the early hours of 31 July 2006 casts a pall over the entire Iranian justice system, Amnesty International said today.

“The series of failures to afford Akbar Mohammadi justice have robbed him of his life and his family of human dignity. There can be no more deaths in Iranian custody. A thorough reform of the criminal justice system is urgently needed,” added the organisation.

“The Iranian authorities need to take urgent measures to ensure that political prisoners are afforded a fair and open trial; that torture and other ill-treatment in Iranian prisons is halted and that the practice of delaying or denying medical care is stopped immediately.”

Amnesty International is alarmed at reports indicating that following an inspection of Akbar Mohammadi’s detention conditions by senior officials he was administered a drug which may have resulted not only in his tranquillisation but possibly, as a result of a complication, his death.

From around 21 July, Akbar Mohammadi had reportedly undertaken a hunger strike, the last three days of which he refused liquids as well as solids.

Amidst reports that an autopsy has been carried out domestically by the coroner (pezeshk-e qanouni), Amnesty International considers that there needs to be an independent investigation and autopsy by fully independent pathologists to determine the cause of Akbar Mohammadi’s death and the conditions that facilitated it.

Principle 9 of the UN Principles on the Effective Prevention and Investigation of extra-Legal, Arbitrary and Summary Executions states: “There shall be thorough, prompt and impartial investigation of all suspected cases of extra-legal, arbitrary and summary executions, including cases where complaints by relatives or other reliable reports suggest unnatural death in the above circumstances. […] The purpose of the investigation shall be to determine the cause, manner and time of death, the person responsible, and any pattern or practice which may have brought about that death. It shall include an adequate autopsy, collection and analysis of all physical and documentary evidence and statements from witnesses.”

Amnesty International also expressed concern that political prisoners Heshmatollah Tabarzadi, Ahmad Batebi and Akbar Mohammadi’s brother Manuchehr are facing heightened risk following this latest death in custody.

Background
Akbar Mohammadi was one of the thousands of students arrested in July 1999 after student demonstrations which erupted following the closure of newspapers and one of the periodic clampdowns on freedom of expression that occurred throughout the late 1990s in Iran.

Akbar Mohammadi and other students were sentenced to death in September 1999 following a manifestly unfair trial. He was brutally tortured while in incommunicado detention, denied the right of legal representation and access to family. Following domestic and international outcry, in November 1999 the sentences were commuted to 15 years’ imprisonment.

From the day of his arrest, Akbar Mohammadi was routinely tortured. While in the custody of the Ministry of Intelligence, he was allegedly suspended by his arms, and violently beaten. Guards beat him to the edge of consciousness, telling him that all he had to do was blink to accept the charges against him.

The information available strongly indicates that the repeated delays or outright denials of adequate medical care by Iran’s judicial and prison authorities have contributed to his death in custody. At the end of November 2003, for example, judicial authorities permitted his hospitalisation in response to urgent stomach and kidney problems, internal bleeding and possibly a lung infection. Despite medical advice that he be hospitalised for one month, he was returned to Evin Prison one week later.

Between July 2004 and June 2006, Akbar Mohammadi resided at his family home in Amol, northern Iran, where he received medical treatment and wrote a prison memoir. He was re-arrested on 11 June 2006 and returned to Evin prison where, once again, he was denied the right to meet with his family. Following one visit by his lawyer, Akbar Mohammadi was said to be in ill health and suffering from acute abdominal pain. Prison medical staff reportedly advised that he should be removed from prison for medical treatment.

According to sources inside Evin prison, he sought medical care from around 26 July during his hunger strike but he was chastised by medical officials who rejected his request. Between 26 and 29 July, he was reportedly provided unspecified treatment, though an Iranian parliamentary delegation visiting Evin prison was denied permission to visit the section of the prison -- possibly the clinic itself -- in which he was held.

On or around 29-30 July he was reportedly gagged and bound to a bed while senior officials visited the prison. The Chief Prosecutor for the province of Tehran, Said Mortazavi, and two senior prison officials, along with a prison guard reportedly inspected him on 30 July, during which time he was administered an unspecified ‘medicine’. His condition reportedly worsened in the course of that day and he died on 31 July. Despite the call by his lawyer that his body be examined by an independent team of pathologists, his body was transferred to a coroner on 31 July.

Akbar Mohammadi’s parents arrived at Imam Khomeini Airport in Tehran on Tuesday 1 August 2006, at 02:30 local time, from a visit outside the country. They were forcibly taken directly from the aircraft to awaiting vehicles and driven directly to their house in Amol, northern Iran. They were denied permission to see the body of their deceased son, as was his brother Manuchehr, who remains in Evin prison. At the time of writing, there are reports that the body of Akbar Mohammadi has been buried.

WASHINGTON (AFP) - The United States harshly condemned what it called Iran's "severe repression of dissidents" following the death of a jailed student activist, reportedly as the result of a long hunger strike.

Student activist Akbar Mohammadi died Sunday in Tehran's Evin prison, where he had been held for his role in pro-democracy student demonstrations in July 1999.

State Department spokesman Sean McCormack said Mohammadi's detention "was not an isolated case" and his death was symptomatic of the Iranian regime's harsh treatment of its opponents.

"The United States condemns the Iranian government's severe repression of dissidents, and its continued crackdown on civil society and those fighting for personal freedom in Iran," McCormack said.

He said Mohammadi's brother Manouchehr remained imprisoned for participating in the same 1999 rallies, and that there were recent reports that his parents may have been arrested as well.

"These arrests, and the harsh treatment of dissidents and opposition leaders, are part of a deliberate campaign by the Iranian government to silence the student movement in particular, and civil society more broadly," he said.

"The United States is gravely concerned about the crackdown by the Iranian regime against its opponents and dissenters, and about the status of those who are currently being held by the Islamic Republic," he said.

He specifically mentioned Ali Akbar Moussavi Khoeini, a former member of parliament and student leader imprisoned since being arrested on June 12 during a women's rights rally in Tehran, and jailed union leader Mansour Osanloo.

"We call on the Iranian government to respect the human rights of all Iranian citizens, including students, members of religious minorities, workers, and women, and to release those arrested and imprisoned as a consequence of defending universally accepted human rights and freedoms," he said.

The US condemnation comes amid ongoing tensions between the West and Tehran over Iran's alleged program to develop nuclear weapons.

The United States and its fellow members of the UN Security Council on Monday adopted a resolution that requires Iran to halt uranium enrichment and other sensitive nuclear fuel work by August 31 or face the prospect of sanctions.

Washington has also blamed Iran for fomenting the ongoing crisis between Israel and Lebanon through its support for the Lebanese Shiite militia Hezbollah.

The United States is gravely concerned about the crackdown by the Iranian regime against its opponents and dissenters, and about the status of those who are currently being held by the Islamic Republic. How much whining and complaining have you heard from the UN that the bloodthirsty terrorist prisoners at Gitmo are being denied their human rights: their duck a l'orange is lukewarm or some other nonsense. Every single aspect of America's fight against Islamic terror is subjected to the most intense scrutiny and always with a presumption of guilt. The reality, of course, is that the combatant detainees we hold, who have earned no rights because they have broken every law of war, are granted those rights nevertheless because we, unlike them, are a decent society.

Meanwhile, the UN has no time to rant and rave about genuine human rights violators like Iran:

Democracies are the natural allies of pro-democracy activists around the world. They should not ignore the alarming surge in assassinations and the massive
crackdown that Iran has launched against pro-democracy activists who call for the respect of the fundamental freedoms, and an end to discriminations based on religion, gender, and political beliefs.

This is the regime France calls a "stabilizing" force. Does anyone have an answer to the question of why the West, aside from a handful of exceptions, engages in an orgy of self-loathing to criticize itself and refuses to defend its majestic gifts of the Enlightenment - individual freedom and the right to pursue individual thought - but rather bends over backwards to excuse, legitimize and accomodate the violent forces of bigotry, intolerance and hate? If that does not change soon, the West will cease to exist in a timeframe that makes the global warming myth irrelevant.

At the end of July, the Supreme Court reportedly upheld the death sentences against Nazem Bureihi, Mohammad Ali Sawari, Yahia Nasseri, Abdulzahra Helichi and Abdul-Imam Za’eri. Amnesty International is concerned that they are at risk of imminent execution.

The men were reportedly sentenced to death at the beginning of June by a Revolutionary Court in the city of Ahvaz, Khuzestan province. They were charged with acting against national security, "waging war against God" ("mohareb") and carrying out bombings in Ahvaz, which took place between June and October 2005. No details of which bombings they were alleged to have participated in were made public nor was the exact date of their execution revealed.

Amnesty International currently has no further information about Yahia Nasseri, Abdulzahra Helichi and Abdul-Imam Za’eri. However, Mohammad Ali Sawari was reportedly arrested on or around 4 November 2005. Nazem Bureihi has reportedly been in custody since 2000 having been arrested on charges of "insurgency". Though he was serving a 35 year prison sentence, he was among nine men shown on Khuzestan Provincial TV on 1 March 2006, "confessing" to involvement in the October 2005 bombings.

Given the secretive nature of the trials in Iran, the current stage of the legal proceedings against the other men is unclear to Amnesty International.

BACKGROUND INFORMATION

Much of Iran's Arab community lives in the province of Khuzestan which borders Iraq. It is strategically important because it is the site of much of Iran’s oil reserves, but the Arab population does not feel it has benefited as much from the oil revenue as the Persian population. Historically, the Arab community has been marginalised and discriminated against. Tension has mounted among the Arab population since April 2005, after it was alleged that the government planned to disperse the country's Arab population or to force them to relinquish their Arab identity. Hundreds have been arrested and there have been reports of torture.

Following bomb explosions in Ahvaz City in June and October 2005, which killed at least 14 people, and explosions at oil installations in September and October, the cycle of violence has intensified, with hundreds of people reportedly arrested. Further bombings on 24 January 2006, in which at least six people were killed, were followed by further mass arrests. Two men, Mehdi Nawaseri and Ali Awdeh Afrawi, were executed in public on 2 March after they were convicted of involvement in the October bombings. Their executions followed unfair trials before a Revolutionary Court during which they are believed to have been denied access to lawyers, and their confessions, along with those of seven other men, were broadcast on television.

RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in English, Arabic, Persian or your own language:
- stating that Amnesty International recognizes the rights and responsibilities of governments to bring to justice those suspected of criminal offences, but strongly opposes the death penalty as the ultimate cruel, inhuman and degrading punishment and violation of the right to life;
- urging that the death sentence imposed on Nazem Bureihi, Mohammad Ali Sawari, Yahia Nasseri, Abdulzahra Helichi and Abdul-Imam Za’eri be commuted immediately;
- seeking full details of the status of all 12 men (naming them), including any details of any charges and evidence against them and any appeals they may have made;
- expressing concern at reports that they were not granted access to a lawyer during some or all sessions of their possible trials, which reportedly did not meet international standards for a fair trial, as laid down by Article 14 of the International Covenant on Civil and Political Rights to which Iran is a State Party.
- calling for the 12 men to be given continuous access to lawyers, their families, interpreters and medical treatment if necessary;
- seeking assurances that they are not being tortured or ill-treated in detention.
